1. About these Terms

Welcome to Painted by Hannah Joy. These Terms of Service are a binding agreement between you and the operator of Painted by Hannah Joy (referred to as we, us, or the Operator) and govern your access to and use of our website, membership, content, and community (together, the Platform).

By creating an account, purchasing a membership, or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

2. Who can use the Platform

You must be at least 18 years old to purchase a membership. You may create an account if you are at least 13 years old, and if you are under 18 you may only do so with the involvement and consent of a parent or legal guardian. The Platform is not intended for children under 13, and we do not knowingly allow them to create accounts.

By using the Platform you represent that you meet these requirements and that the information you provide is accurate.

3. Your account

Sign in and identity are handled by our authentication provider. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Please give accurate information and keep it current.

You may not share your account, sell or transfer it, or let anyone else use it to access members only content. We may suspend or close accounts that appear to be shared, automated, or fraudulent.

4. Membership, billing, and auto-renewal

A paid membership costs $19.99 per month unless we clearly state otherwise at the time of purchase. Your membership begins when your first payment is confirmed and gives you access to the members only content and community for as long as it stays active.

Payments are processed by Creem, which acts as our Merchant of Record and authorized reseller. This means Creem handles the checkout, billing, receipts, and any applicable sales tax, and your purchase is also subject to Creem's own terms and policies. We do not receive or store your full payment card details.

Your membership renews automatically each month and your chosen payment method is charged on each renewal date until you cancel. By subscribing, you authorize these recurring charges. If a payment fails, your access to members only areas may be paused until payment is resolved.

We may change membership pricing or features from time to time. If we change the price of an active membership, we will give you advance notice, and the new price will apply to renewals after the notice period.

5. Cancellation and refunds

You can cancel your membership at any time from your account settings on the billing page. When you cancel, your membership stays active until the end of the period you have already paid for, and it does not renew after that. We do not provide partial refunds for the unused part of a billing period.

Because the Platform provides digital content that is available to you immediately, memberships are generally non-refundable once a billing period has begun, except where a refund is required by law or provided under Creem's refund policy. If you believe you were charged in error, contact us and we will work with you and with Creem to look into it.

You can delete your account at any time. If you have any trouble cancelling or need help, email us at help@hannahjoyy.com and we will assist you.

6. What your membership includes

An active membership gives you a personal, limited, non-exclusive, non-transferable, and revocable license to stream and view the members only content for your own personal, non-commercial enjoyment while your membership is active.

This license does not transfer any ownership. You may not download, copy, record, screen capture for redistribution, repost, sell, sublicense, publicly perform, or otherwise share the content outside the Platform, and you may not use it to train any machine learning or artificial intelligence system.

7. Intellectual property

All content on the Platform, including photography, videos, tutorials, courses, written material, graphics, logos, and the Painted by Hannah Joy name and branding, is owned by Hannah Joy or the Operator, or is used with permission, and is protected by intellectual property laws. Except for the limited license described above, no rights are granted to you.

8. Community and content you post

The Platform includes community areas where you can post messages and interact with other members. You are solely responsible for what you post, and you confirm you have the right to post it.

You keep ownership of the content you post. You grant us a worldwide, non-exclusive, royalty free license to host, store, display, and distribute your posts within the Platform for the purpose of operating and moderating the community. This license ends when you delete your content or your account, except for copies retained for backups, legal compliance, or safety.

• Do not harass, threaten, bully, or abuse other members or staff.
• Do not post hateful, illegal, sexually exploitative, or infringing content.
• Do not post nudity or any sexual content of any kind (see the next section).
• Do not share, leak, or redistribute members only content anywhere outside the Platform.
• Do not spam, advertise, scrape, use bots, or attempt to collect other members' information.
• Do not impersonate Hannah, staff, moderators, or other members.

9. No nudity and no sexual content

Painted by Hannah Joy is a makeup and cosplay platform, not an adult platform. Nudity and sexual content are strictly prohibited everywhere on the Platform. This applies to everything you send or upload, including messages, direct messages, community posts, images, videos, GIFs, profile photos, usernames, bios, content requests, and live chat.

This means no nudity, partial nudity, or sexually explicit or suggestive imagery; no pornographic or fetish material; no sexual solicitation, propositioning, or requests for sexual content; no sexually explicit language directed at Hannah, staff, moderators, or other members; and no attempt to arrange, buy, or sell sexual content or services. Hannah does not create, sell, or provide nudity or sexual content, and requests for it will be refused and are non-refundable.

If you post, send, request, or engage in nudity or sexual content, your account will be banned. We may remove the content and ban the account immediately and without warning, we do not owe a refund for a membership or any purchase when we do, and where content is illegal, including any content that sexualizes minors, we will preserve relevant information and report it to the appropriate authorities. Keep it warm, creative, and clean.

10. Acceptable use of the Platform

You agree not to misuse the Platform. In particular, you may not attempt to bypass access controls or paywalls, reverse engineer or interfere with the Platform, access it through automated means, probe or test its security, upload malware, or use it in any way that breaks the law or infringes anyone's rights.

11. Moderation and enforcement

We want the community to stay warm and safe. Moderators and administrators may remove content, issue warnings, mute, suspend, or ban accounts that violate these Terms or our community guidelines, at their reasonable discretion. We are not obligated to monitor content, but we may review and act on it. A banned account may keep the ability to sign in but loses access to posting and to members only areas.

12. Suspension and termination

You may stop using the Platform at any time by cancelling your membership and, if you wish, deleting your account. We may suspend or terminate your access if you violate these Terms, engage in fraud or abuse, issue a chargeback in bad faith, or if we are required to by law.

If your access ends because you violated these Terms, you are not entitled to a refund. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will continue to apply.

13. Third-party services

The Platform relies on trusted third-party providers for authentication, database and hosting, payments, media storage, email, and realtime messaging. Your use of features powered by these providers may also be subject to their terms, and we are not responsible for the acts, omissions, or outages of third parties beyond our reasonable control.

14. Disclaimers

The Platform and all content are provided on an as is and as available basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error free, or secure.

Tutorials and courses are provided for education and entertainment. Results depend on your own practice, materials, and skill, and we do not guarantee any particular outcome.

15. Limitation of liability

To the fullest extent permitted by law, the Operator and Hannah Joy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Platform.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Platform will not exceed the greater of the total amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless the Operator, Hannah Joy, and our staff and providers from any claims, damages, losses, and expenses, including reasonable legal fees, arising out of your use of the Platform, your content, or your violation of these Terms or of any law or third-party right.

17. Dispute resolution, arbitration, and class action waiver

Please read this section carefully, as it affects your legal rights. First, we want to resolve concerns informally. Before starting a formal dispute, you agree to email us at help@hannahjoyy.com and give us at least thirty days to try to resolve it.

If we cannot resolve it, you and we agree that any dispute arising out of or relating to these Terms or the Platform will be resolved by final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court where eligible. You and we waive any right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class or representative action.

You may opt out of this arbitration agreement within thirty days of first accepting these Terms by emailing us at help@hannahjoyy.com with your name and account email and a clear statement that you opt out of arbitration.

18. Governing law

These Terms are governed by the laws of the State in which the Operator is based and the applicable laws of the United States, without regard to conflict of law rules. Where arbitration does not apply, the state and federal courts located in that state will have exclusive jurisdiction, and you consent to that jurisdiction and venue.

19. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, give notice through the Platform or by email. Your continued use of the Platform after the changes take effect means you accept the updated Terms.
